| 摘 要： | 本文以法与道德的一般联系为线索 ,深入总结了影响中国古代法律的内容、形式、特点等 ,并紧紧围绕道德是法律目标与法律是道德手段两个命题展开论述 ,对其危害法治建设的消极性进行了分析 ,以期从历史中吸取某些可借鉴之处。

| Abstract: | WT5BZ]This paper,following the clue of the general relationship between law and morality,thoroughly summarizes the contents,forms and characteristics arising from the influence of morality on ancient Chinese laws.It also makes its argument centering on the two propositions of morality as an objective of law and law as a means of morality,analyses the negative nature of morality undermining legal construction so as to learn something from historical experience.
