| 摘 要： | 挪用公款与其他罪名之间是存在牵连关系的,其中以与受贿罪相牵连最为突出.根据最近的司法解释及相关规定,应当结合挪用公款罪牵连犯的表现形式,确定挪用公款的牵连犯应该评价为数罪还是一罪,进而按照所牵连的不同罪名而分别处以数罪并罚或者从一重罪从重处罚.

| Abstract: | There is an implicated relation between defalcation and other crimes.Among them,the bribery crime is the distinctness.On basis of the judicatory interpretation and the correlated regulations,integrating the forms of the defalcation,we should make sure how to judge the implicated offence of defalcation__to be one crime,or several crimes? To some others,we should prosecute more than one imputation.Consequently,to some implicated offenders,we should accuse them of one crime and severe punishment,however,to some others,we should combine the punishments. |
