| 摘 要： | 离婚损害赔偿制度是我国婚姻家庭立法改革的重大成果,是面向二十一世纪的我国新婚姻法的重要里程碑。本文通过对世界各国离婚损害赔偿制度比较研究,揭示出我国离婚损害赔偿责任的性质是一种过错侵权责任,具有不同于其它民事责任的特殊性,并为我国婚姻家庭制度的完善提出建议。

| Abstract: | Divorce damage compesation system is a great outcome of matrimonial family' s legislative reform. It is an important milestone of china's new marriage law faced with the 21st century .By contrastive research to corresponding systems of all coun-troies in the world,the article reveals that its reponsibility is a kind of tort which has its own character different form other civil liabilites.Personal views and suggestions are also offerred for perfecting china s matrimonial family system. |
