| 摘 要： | 香港刑法中并没有正当防卫的概念,而合法使用武力中的防卫人身和防卫财产相当于我国内陆刑法中的正当防卫。两地有关正当防卫的成立条件既有相同之处,又存在着一些差异。

| Abstract: | The conception of "justifiable self-defense" doesn't exit in Criminal Law of Hong Kong. However it is legal to fall back on force to defense personal right and property right, which is equal to" justifiable self-defense "of mainland Criminal Law. There are differences and sameness of prerequisites about justifiable self-defense. |
