| 摘 要： | 非犯罪化是当今世界刑法发展的趋势和潮流之一。而欲借鉴非犯罪化,就必须清楚非犯罪化产生的社会背景、价值追求、刑法理论的根基及对非犯罪化的合理界定。本文拟就以上问题进行分析、界定,以期推动在中国法治环境下的非犯罪化。
