| 摘 要： | 保险诈骗罪的直接客体是保险制度或保险秩序,具体而言,是保险合同关系或保险利益.保险诈骗罪的客体是简单客体,不是复杂客体.其犯罪对象是保险金.保险诈骗罪的同类客体是社会主义市场经济秩序.犯罪客体是复杂客体还是简单客体,关键是看犯罪构成要件的行为所侵害的对象反映出什么社会关系或社会利益.

| Abstract: | The direct object of insurance defraud is insurance system or insurance order, that is to say, relationship of insurance contract or insurance interests. The object of insurance defraud is simple object other than complex one. The target of insurance defraud is insurance indemnity. The kindred object of insurance defraud is socialist market economy order. Whether the object of crime is complex one or simple one depends on the social interests of the social relationship reflected by the target changed by requisites to constitute a crime. |
