| 摘 要： | 传统过失犯罪理论构建的不法体系以注意义务为中心,由于注意义务的根据来源颇广,在司法实践中主要由法官在个案中具体补充,因而过失犯罪的构成要件是开放的,不能有效地限制法官的自由裁量权,不利于保障公民的权利和自由.作为近几十年来在德国乃至欧洲比较流行的刑法理论,客观归责理论主要是为解决过失犯罪的不法问题而发展起来的.它为过失犯罪构建的以危险原则为核心的全新不法体系,重视行为在客观面上的不法特征,克服了传统过失犯罪理论的缺陷,不但实现了过失犯罪的准确认定,而且也符合了现代刑法学精确化发展的趋势.

| Abstract: | Conventional theory of negligent crimes provides the illegitimacy system focused on the liabilities of prudence,which are mainly stated in many laws and regulations.Different from those of intentional crimes,the constituent elements of negligent crimes are open,which expands the discretion of judges to a certain degree.The theory of objective imputation has developed in Germany specially for resolving the illegitimacy of negligent crimes,and highlighted the objective illegitimate features of acts,and built a new system of risk principle.Following the tendency of precise development of the criminal jurisprudence,it can help the correct conviction of negligent crimes. |
