土地征收中被征收人财产权利保护研究

土地征收是实现现代化和城镇化的重要途径,也是公共利益与私权利益实现再分配的过程。重新构建征收利益分配机制,完善征收补偿程序,引入司法最终裁决机制,将是解决土地征收过程中征收利益分配不合理、补偿标准低、被征收人在补偿定价机制中话语权缺失等问题的重要途径,也是保障被征收人合法权益的有益探索。

Study on Protection of Property Rights of the Requisitioned on Land Acquisition

The land acquisition is an important way to achieve modernization and urbanization,and also is a process of redistribution of the interests of the public interest and private rights.We need to take the following measures：rebuild the interest distribution mechanism of acquisition,improve the procedures of compensation,and introduce the judicial mechanism for the land acquisition. These measures would be overcome such questions as unreasonable acquisition of the distribution of benefits, low compensation stan- dards,lack of the right to speak compensation pricing mechanism in process of the land acquisition.It is the useful exploration that protects the legitimate rights and interests of the people.
