| 摘 要： | 询问证人是侦查人员在侦查过程中向了解案件情况的人搜集破案线索和获取证言的一种侦查措施。证人提供的证言是刑事诉讼中最为普遍的证据来源,询问证人也就成为了侦查过程中运用最普遍的侦查措施之一。正确的把握证人的内涵和外延、准确了解证人的权利义务对指导公安司法实践无疑具有重要的理论和现实意义。本文立足于我国实际,利用比较法的方法,对上述问题进行了分析,并提出了完善询问证人制度的建议。

| Abstract: | Questioning witnesses is a kind of detective method of collecting evidence, clues and gaining testimonies from those who know the cases in the process of investigation. Testimonies provided by witnesses are the most general evidence source and one of the most general detective measures. Correctly grasping witnesses' meaning and understanding their rights and obligations are of theoretical significance to instructing the public security practice. The article gives analysis to the problems mentioned above by means of comparison and puts forward suggestions to consummate the system of questioning witnesses. |
