| 摘 要： | 法律程序是法律制度的实践基础,在结构上可以区分为程序规则、程序行为两个组成部分。程序行为是法定的要式行为,程序规则是不同于实体法律规则的构成性规则。程序保障,或说权利的程序保障,是现代法律程序的基本原则,也是现代法律程序有别于前现代法律程序的标志。正是程序保障原则赋予了现代法律程序独立于实体法律而存在的制度空间。

| Abstract: | The legal procedure is a practice foundation of the legal system, and includes procedure rules and procedure behaviors in structure. The procedure behavior is a legal must behavior and procedure rules are compositional rules different from legal entity rules. Procedure guarantee, in other words, procedure guarantee of rights is the basic principle of modern legal procedures. Meanwhile, it is also the symbol of modern legal procedure different from the pre- modern one. It is right the principle of procedure guarantee that makes the modern legal procedural independent of the entity law. |
