论中国传统警察的“秩序化”——兼与英国传统警察的比较

中国传统社会秩序状态的达成,乃是以限制或剥夺民众的权利自由为代价的,关键原因在于其独特的专制政治文化:在“家天下”格局通过残酷战争、暴力革命等“流血”方式不断更迭的背景下,统治者与普通民众很难建立互信、互谅、互让、互爱的关系。因而,中国传统警察以消极维持社会秩序,而非积极保护民众权益为宗旨。统治者还炮制种种理论对之加以包装、掩饰。客观而论,中国传统警察固然因秩序而漠视民众权利,甚或有维护权贵,纵容不法的恶名,却仍将对民众切身利益之保护纳入其秩序范畴。

On the "Regularization" of Chinese Traditional Police--A Comparison with British Traditional Police

The "regularization" of traditional Chinese society is at the cost of depriving the public of their right of freedom. The main reason is due to its special autarchy political culture: it is very difficult for the archon to establish a relationship with the public on the basis of mutual trust, mutual understanding, give-and-take and mutual love. However, Chinese traditional police maintain the social order passively instead of actively protecting the interests of the public.
