| 摘 要： | 规划许可建筑因有合法的外衣,与相邻不动产之间的采光权纠纷具有特殊性。建筑取得规划许可不应成为加害人采光权侵害的免责事由;规划许可建筑影响相邻不动产采光超过受害人通常的忍受义务,构成采光权侵害;对采光权侵害的民事救济方法主要有物权法上的停止侵害、排除妨碍和侵权法上的损害赔偿。

| Abstract: | The lighting right disputes over the licensed building and the neighbouring real estate is special,because of the legality of the licensed building.If the neighbouring party infringes on the other party's lighting right by his licensed building,he shall not be exempted from civil liability.If the ill effects on the lighting of the neighbouring real estate that the licensed building causes surpass ordinary obligation that the neighbouring party shall be bore,which means the infringement on the lighting right,the victims shall have the right to demand that the infringement be stopped,the obstruction be eliminated and the damage be compensated for. |
