从程式到程序：公安执法规范化建设的一种进路

目前,在我国公安机关执法规范化建设过程中,出现了把“程式”等同为“程序”的谬误,造成实际上的程序性缺陷现象。究其原因主要有三点：一是传统执法程序的残留;二是社会转型期客观形势的影响;三是立法技术的缺陷。因此,公安机关必须走出思维误区,增强程序意识;充分调动行政执法人员的积极性;努力构建合理有效的法律监督机制。只有这样,公安执法规范化活动才能不流于形式,公安队伍建设才能真正朝着群众满意的方向不断前进。

From Ceremony to Program: Another Way to Standardize the Administration of Public Security

At present, when our public security organs administrate the law, they focus on the ceremony and neglect the program. The＇re is phenomenon that they do not apply the law in an all-round way but consider law on paper. There are three reasons leading to this kind of program defect： firstly, the remains of the traditional administration program; secondly, the influence from the transaction period which our society undergoes; thirdly, the defect of the legislative technique. Thus, public security organs should be out of the wrong thinking pattern, enhance the awareness of program, mobilize the initiative of the program user, and attempt to build a considerate and effective supervisory mechanism in law system. Only in this way will public security organs administrate according to the standards and will the construction of the public security organs be in the direction of people＇s satisfaction.
