| 摘 要： | 我国学者对持有型犯罪属何种行为方式有不同看法 ,这些观点大多数是确定了犯罪行为可分为作为与不作为的前提下去界定持有行为的行为方式 ,这种演绎思维方式存在方法论错误。持有行为是一种新型的犯罪行为 ,它属何种行为方式应以其自身行为性质去界定。
