| 摘 要： | 对于暗中帮助他人实行犯罪行为的认定,历来就有片面共犯说与间接二犯说之争,它们要么将此行为一律视为片面共犯,要么全部认定为间接二犯,笔者认为,二说均有以偏概全之嫌,所以试图经过对此行为的分析论证得出认定的界分点,并认为在一般情况下,该行为成立片面共犯．但在暗中帮助者具有与被帮助者不同的目的时,该行为应当而且接间接二犯处理,从而对片面共犯说与间接正犯说进行了扬弃．
