| 摘 要： | 由于新刑诉法取消了撤回公诉的规定，引起了法学界对撤诉制度的争论．该文着重从撤诉权的理论基础一一起诉便宜主义和实事求事原则进行了阐述，并就如何确立撤诉制度进行了较为深入的探讨，提出了撤诉案件的适用范围和撤诉程序的设想．
