| Abstract: | Equality and autonomy are the basic principles of the Civil Law and the Contract Law. Through expounding the character of legal relation and connecting the reality, this thesis analyzes three primary problems existing in the recent realty management, that is, inequal status of subjects, asymmetrical rights and obligation and unstandardized management movement. Bases on the above discussion, this thesis finally provides the resolution in three aspects:structural reform, social environment for rule by law and management concept. |
