论审判的自治与控制

文章思考了审判自治的法治蕴涵，认为中国审判改革的选择不在移植审判自治的制度， 而在于给审判再生产提供自我完善的条件， 并进行必要的控制， 且审判控制并不能取代法官的自主审判。审判的自主和控制是审判改革中的一对矛盾，二者整合于审判公开。

The Autonomy and Control of the Trial

After having considered the meaning of judicial autonomy in law, the author thinks that the choice of Chinese trial reform is not to transplant an autonomous system of the trial, but to provide a condition of self improvement. It is necessary to control the trial, but this control cannot replace the autonomy of a judge. The judicial autonomy and control are a pair of the contradictions in the reform and they depend on the judicial openness.
