虚假广告的认定及其治理

摘    要:市场经济离不开广告,然而,虚假广告的大量出现,不但损害了消费者和同行竞争者的利益,而且扰乱了市场经济秩序.究其原因,主要是我国现有法律制度的不健全、经济利益的驱动和其他方面的原因.为了严厉打击虚假广告,维护消费者权益,规范市场经济秩序,应该完善立法和执法工作,加强惩处力度,发挥教育和监督的功能,坚持预防与治理双管齐下,从而有效遏制虚假广告.

Abstract:The market economy needs advertisement,however,the emergence of false advertisement does not only harm the consumers and the colleague competitors' benefits,but also disturb the order of the market economy.The reason for false advertisement mainly is the distemperedness of the law system of our country and many persons try to pursue economic benefits from false advertisement,and so on.In order to prevent false advertisement,protect the rights of consumers,and adjust the order of the market economy,we should perfect the work of legislation and administration,punish the false advertisement more severely,take advantage of law education and supervision,insist on both guarding and punishment,only in these ways can we prevent the false advertisement effectively.
