试论我国宪法实施现状、成因及对策

宪法的有效实施于法治是十分重要的。我国宪法的实施现状不容乐观 ,主要表现在 :(一 )宪法不能进入诉讼 ;(二 )宪法监督制度名不副实。究其原因 ,主要有三 :(一 )公民宪法意识淡薄化 ;(二 )宪法功能政治化 ;(三 )宪法价值虚无化。我国宪法的实施陷入了实体与程序背离的两难境地。必须建立宪法诉讼制度和违宪审查制度 ,确实保障我国宪法有效地实施。

On the Present Situation of Constitution Enforcement the Causes of Formation and the Countermeasures

The effective enforcement of constitution is very important for the rule of law.However,it does not allow of optimism in China because:(1) constitution can not enter into action;(2) the supervision of constitution does not match the reality.The causes of the above are the following:(1) the weakness of the constitutional sense of the citizens;(2) the politicalization of the constitutional functions;(3) the nihilism of the constitutional value. In a word,constitution enforcement in our country has fallen into the dilemma of the separation of substance and procedure. Only the further perfection of procedures,i.e.,the establishment of constitutional proceedings and unconstitutional investigation,can guarantee the effective enforcement of constitution in our country.
