| 摘 要： | 鉴于我国目前牵扯法官偏离公正立场的力量不仅来自法院外部,而且也来自法院内部,需要对法官制度的国际化发展趋势进行评价.近年来,国际社会对法官资格的取保更加严格,法官独立原则得到进一步强化,法官的属审判权不断扩大,对法官的管理更加专门化,失职法官由专门机构进行惩戒.借鉴国际作法,我国法制制度改革的重点应是严格法官资格的选任,为法官提供良好的职能保障,改变法院内部的行政化管理模式,通过建立现代化法官任职制度、晋升制度、考核制度、惩戒制度和法官独立审判制度来实现司法公正和司法效益的价值目标.
