如何在刑事诉讼中落实控辩平等原则

在刑事诉讼中落实控辩平等原则有利于构建合理的诉讼构造；有利于促进实体正义；有利于体现程序正义；有利于保障人权，提高追诉机关的工作水平。目前可通过两条途径来推进控辩平等原则的落实：一是对国家司法机关的行为加以有效的监督和制约，防止其滥用权力；二是对辩方提供与控方平等的武装和平等的保护，为其创造能够与司法机关进行平等对抗的条件。

Implementing the principle of equality between prosecution and defense in the criminal procedure is beneficial to the building of a rational procedure structure, to promoting entity justice, to expressing procedure justice, to safeguarding human rights and to improving the work of prosecutive organizations. At present, there are two ways to implement the principle in an effective way. One is to exercise effective supervision over and restrain the actions of judicial organizations so as to prevent them from abusing their authority. The other is to provide for the defensive side arms and equality protection equal to that of the prosecutive side so as to create a condition under which it can antagonize judicial organizations.
