| 摘 要： | 关于宪法的概念,从不同的角度来定义会有不同的表述。西方国家从宪法内容、形式及阶级本质的角度出发给宪法下了不同定义;我国民国时期对宪法定义严重存在政治工具化倾向;新中国建立后对宪法定义强调阶级性、政治性,20世纪90年代又注重内容。当前,宪法的定义应强调法的特征和实施性。

| Abstract: | On the concept of the Constitution,there are different definitions from different angles.The western nations set out the definitions from the angles of constitution contents,form and class essence.In the period of Republic of China,we emphasized it as a political tool.After new China was established,we emphasized its class and political features.In the 1990s,its contents were paid more attention.At present,the definition of constitution should be emphasized by the characteristic and feasibility. |
