转化犯的立法价值与立法例的理性反思

在我国刑事立法中，转化犯的存在是一个客观现实。转化犯的立法价值在于，体现了罪刑均衡与罪刑法定的刑法原则、符合刑法谦抑性、解决了实践操作难题。以犯罪结果、犯罪行为与犯罪方法的不同，可以把转化犯分为以严重结果为转化条件的转化犯、以犯罪条件为转化条件的转化犯、以犯罪行为为转化条件的转化犯三大类。通过仔细分析三大类转化犯的立法例，现今立法的不足得以呈现，需要在立法技术上予以逐一应对。细化转化犯相对应的罪名，体现罪刑均衡。

In China＇s criminal legislation, the existence of conversion criminal is a reality.The legislation value of conversion criminal lies in its crime balance and criminal principle in crime ,which is in line with the Criminal law ,and it solves the practical operation issues. We can divide conversion criminals into three categories： serious outcome conversion offenders, criminal conditions conversion offenders, criminal behaviors conversion offenders, according to the difference of criminal outcomes, behaviors and approaches.Through careful analysis in legislative examples of the three categories of offenders into the legislative cases, the current lack of legislation emerges, it needs to be correspond one by one in legislation technology, refine into the corresponding charges reflect the balance of crime and punishment.
