| 摘 要： | 刑讯逼供、超期羁押等问题是长期以来公、检、法机关执法过程中存在的顽症 ,“有罪推定”的观念的根深蒂固是产生执法弊端的症结所在。确立无罪推定原则对于抑制执法弊端 ,保证司法公正和效率有着十分积极的意义。

| Abstract: | There exists some persistant problems,such as extorting professions by torture,overdue detention,etc,which has been distressing the enforcement of judicial organs all the time.The deep-rooted concept of"guilty presumption"is the cause of the disadvantages of enforcement. Therefore,the principle of"innocent presumption"should be established because it has positive significance in containing such disadvantages so that the fairness and efficiency of justice can be guaranteed. |
