| 摘 要： | 人格权的商品化问题早已引起了我国学术界的广泛关注,不同学术领域的专家学者从不同的权利定性出发,对人格权益中财产利益的保护问题进行了有益的探讨。以我国人格权法的修订为契机,再次探讨此问题,应在人格权体系中明确人格标识的概念,进一步界定人格标识中的财产利益,并对比分析国外发达商品经济国家相关问题的理论研究和法律规定以及我国目前相关问题的学术研究和法律规定,完善我国人格标识中财产利益法律保护。

| Abstract: | The commercialization of the personality right has drawn wide attention of the academic circles in China,and many scholars from different academic fields have being probed into property interest protection of personality benefits.Taking the opportunity of China＇s amending the Personality Right Law,this paper discusses this problem again,noting the necessity to improve the property interest protection of the personality identification in China by means of clarifying the concept of personality identification,further defining the property interests of the personality identification,comparing relevant theoretical research results and legal stipulations between the advanced countries and China. |
