| 摘 要： | 传统刑法理论对于＂交通工具＂的认识和理解存在误区和空白,需要修正和明晰：包括私人所有、使用的小轿车在内的各种私人所有、使用的交通工具都属于破坏交通工具罪中的＂交通工具＂。认定本罪中的＂交通工具＂必须符合三大特征：一是必须具备公共性背景特征,但交通工具自身不必天然具备公共性交通运输特征;二是必须具备对象性特征,即必须可以解释为法定的5种交通工具;三是不要求具备现代化特征或曰符合＂现代化＂标准。

| Abstract: | Some misconceptions or gaps in the knowledge of ＂means of transportation＂ in the traditional theories of criminal law should be amended or clarified,and all transportation means privately owned or used,including cars are ＂means of transportation＂ in the crime of sabotaging means of transportation.The＂means of transportation＂ in this crime should conform to three main characteristics： First,although the characteristic of public background is a must,the means of transportation themselves needn’t to possess natural characteristics of public transportation;Second,means of transportation shall have objectivity characteristics,which could be interpreted as statutory five means of transportation;Third,modern characteristics are not required standard. |
