| 摘 要： | 修改后的刑事诉讼法和相关机关制定的刑事诉讼法法律解释都已于2013年1月1日生效。刑事诉讼法法律解释在指引相关机关进行刑事诉讼活动时起着举足轻重的作用。然而,理论界对刑事诉讼法法律解释的研究严重滞后和缺失。因此,加强刑事诉讼法法律解释的研究,从立法主义转向解释主义显得尤为迫切和必要。梳理刑事诉讼法法律解释的原因、功能等基本问题,认清刑事诉讼法法律解释的困境与出路是研究刑事诉讼法法律解释不可回避的问题。

| Abstract: | The revised Criminal Procedure Law and legal interpretations enacted by relevant authorities took effect on January 1,2013,and these legal interpretations of the Criminal Procedure Law play an important role in guiding relevant organs＇ criminal litigation.Owing to the lagging behind and missing legal interpretations of Criminal Procedure Law in the theoretical circle,it＇s imperative to strengthen the study of this area and shift from the legislationism to interpretivism.Besides,some unavoidable problems such the reasons,functionality,dilemma and outlet of the legal interpretations of the Criminal Procedure Law need to be further studied. |
