司法的制度理性与实践运作

司法制度发展过程中的悖论是由司法的内在矛盾与理论逻辑的困境所决定的，是制度设计的科学性、完备性与理性不可及的矛盾。针对当下司法制度理性存在的偏失，应改革对制度改革惯常的思考方式，加强对司法制度理性的探究，寻求制度理性的创造性适应和一种方法论上的自觉，形成对司法制度的共识，使司法制度设计趋于均衡化、中性化，保证制度规则的公正性，保持必要的理论张力，并达到价值与技术维度的平衡，从而使司法制度在实践理性的基础上获得良性运行。
