刍议事后受贿

事后受贿是受贿罪的非典型形态，我国司法实践中有事前有约定的事后受贿（分为狭义的事后受贿和职后受贿）、事前无约定的事后受贿（分为事前无约定的在职事后受贿和职后受贿）多种事后受贿行为。以受贿罪的实行行为为标准，从目前的司法实践来看，打击贪污腐败的重点应当放在典型的事前受贿和有约定的事后贿赂上；而从理性刑法以及未来的反贪腐工作形势考察，则应将事前无约定的职后受贿与其他类型的事后受贿均以受贿罪论处。
