选举诉讼体制比较研究

作为现代民主政治基石的选举,必然要求其过程与结果能真正公平和合法,选举诉讼制度作为选举的一项重要救济制度应运而生。目前对于选举诉讼的具体范围并没有定论,而且各国对选举诉讼管辖的规定也是多种多样。本文通过对以上内容的比较研究,对我国选举诉讼体制的现状进行分析,并提出完善的措施。

As the foundation of modern democratic politics, election is required to manifest genuine fairness and legality in process and result, the system of electoral action hence come into being as an important remedial system in the election. At the present, there is no definite conclusion to the concrete scope of the electoral action, and the stipulations to the jurisdiction of electoral action in the world are also various. By comparatively studying the above-mentioned contents, this article analyzes the current situation of the electoral action in China and puts forward some measures trying to perfect it.
