讯问犯罪嫌疑人程序研究——以遏制刑讯逼供为目标

在刑事诉讼中,刑讯逼供是被讯问者面临的风险。而刑讯逼供并不体现为身体上的折磨,而应是讯问者形成假设和对被讯问者行使权力的结合体,为实现遏制刑讯逼供的目标,在我国,必然合理构建讯问犯罪嫌疑人的程序体系,其内容包括:1.实现刑事诉讼法律观的转变;2.将我国现行的“由口供到物证”侦查模式转换成由“物证到口供”的模式;3.在讯问程序中注入人文精神,体现“以人为本”的现代法治信念;4.立足本国的国民性,合理获取犯罪嫌疑人的“自白”。

A Study on the Procedures of Interrogating Criminal Suspects

A criminal suspect is often faced with the risk of being exacted a confession by torture in the criminal action. Exacting a confession by torture doesn't merely mean the physical suffering, but a combination of the interrogator's presumption and exercising his rights.In order to contain this phenomenon in our country, we must establish reasonable procedures of interrogating criminal suspects as follows: 1.changing legal views of criminal action; 2. replacing the present investigative mode of " from oral confession to material evidence " with that of" from material evidence to oral confession"; 3. reflecting modern legal idea of humanism in interrogating procedures; 4.reasonably obtaining the criminal suspects' confession according to the features of Chinese people.
