| 摘 要： | 深刻理解和深入贯彻物权法的关键,是充分认识物权法中"物"、"权"和"法"三个基本概念的内涵,并把握好物与物、物与人以及人与人之间的关系。物权以物为客体区别于知识产权、人身权与债权,并筑构了民法的完整体系;以明确物的归属,规范了财产权利的界定,实现定分止争,以明确用益物权和担保物权规范权利的延伸,实现物的增值;物权法以明确财产权来保障人权、推进发展、促进和谐,因而是人权之法、发展之法、和谐之法。
