| 摘 要： | 比例原则包括妥当性、必要性与相称性原则。结合公安行政强制措施的实践 ,比例原则适用时应依照考虑目的的正当性 ;措施选择的多种可能性 ;选择时的相关考虑 ;选择最温和措施 ;不可过度及目的达成应立即终止等六个步骤进行。

| Abstract: | The "Principle of Percentage" consists of principles of property, necessity and suitableness Being combined with the practice of coercive measures by administrative public security organs, the following six procedures should be submitted to when applying the "Principle of Percentage", those are: 1. the property of goals; 2. the various possibilities of measure's choices; 3. the relevant consideration while making a choice; 4. to choose the mildest measure; 5. should not be excessive; 6. should immediately stop the measures when the goal is obtained. |
