| 摘 要： | 无权处分合同有效说与债权形式主义物权变动模式并非不能共存,在所有权债权化的现代,有效说具有较未定说更大的优越性.我国民法典应采有效说解决无权处分问题以实现取消其内部制度间的冲突性,增强和谐性的价值目标.

| Abstract: | It should never be considered that the doctrine of non-right disposition contract having efficiency can't co-ordinate with the mode of transfer of property right through an efficient contract and Transfer or Registration.Nowadays,the ownership is having presented a tendrncy that it turns into obligatory right.In this situation,the doctrine of non-right disposition contract having efficiency possesses more merits than that of the pending efficiency.The Civil Code which is being made in China should adopt this doctrine to resolve the problerm of non-right disposition in order to obtain the value-object which aims at reduceing conflict and increasing co-ordination among the systems in Civil Law. |
