| 摘 要： | 针对侵犯专利权的诉讼,首先要认定行为人是否承担民事责任,其次是认定被告承担何种民事责任。前者与专利侵权民事责任的构成有关,后者主要是认定专利侵权责任时应采取何种归责原则。
