| 摘 要： | 本文通过比较信用卡恶意透支行为和其他三种信用卡诈骗行为在犯罪客体、犯罪主体、犯罪主观方面以及责任转化等方面的差异,得出恶意透支应当独立定罪的结论,并做出立法设计,同时就恶意透支罪相应的主体范围、非法占有目的和银行催收问题提供了司法操作建议。

| Abstract: | Through analyzing between malicious overdraft and three other kinds behavior of fraud on credit card from criminal subject, criminal object, criminal subjective and liability change, it has drawn the conclusion that malicious overdraft should determine a crime independently. And it has the legislative design. Accordingly, it overdraws the judicial operation suggestion on subject range, illegal occupation and bank pressing. |
