| 摘 要： | 清代回避制度集中国历代回避制度之大成，司法回避是其中最为重要的内容之一。传统法制下的清代司法回避，可分为任官回避和听讼回避，朝廷对全国司法官吏的回避情况进行监察和处分，其间利弊互见。
