| 摘 要： | 在既维护法律逻辑,又符合刑事政策精神的前提下,应当肯定“既遂后中止”这一特殊的犯罪中止命题。但这一命题的提出是在我国传统的危险犯定义之下做出的不得已选择,要彻底解决困境必须对传统定义加以反思。

| Abstract: | Concerning the discontinuation of the Potential damage offence,there is a contradiction.if a person voluntarily and effectively prevents the actual damage consequence of Potential damage offence,how to determine the nature of the phenomenon.If not to take it as the discontinuation,it's no good to encourage the offender abandon crime;if to take it as the discontinuation,it would violate the logic of traditional theory and fall short of the criminal policy.To resolve this contradiction,a special concept should be bring forward.It is the discontinuation after completion.But this concept is a unavoidable choice under the logic of traditional theory. |
