| 摘 要： | 近年来,各类中介机构或个人代理转让非上市公众公司股份的行为屡见不鲜,其中资质配套鱼龙混杂,管理水平良莠不齐。代理股份转让行为应界定为证券业务。结合现行法律规定,应根据中介机构的资质有无及具体的行为表现,对代理非上市公众公司股份转让行为作不同的处理。

| Abstract: | In recent years,it is common that shares of non-listed public company were transferred by various intermedi-aries or personal agents,in which various kinds of people and different levels of qualifications and management are involved.The agent behavior of transferring shares should be defined as securities business.Based on the existing legal provisions,we should make different treatments on the agent behaviors of share transfer in non-listed public company according to inter-mediaries' qualifications and specific behaviors. |
