行政合同单方变更、解除权初探

我国目前没有制定统一的行政合同法,在行政合同中,行政机关滥用单方变更、解除权问题亟待解决。建构行政合同单方变更、解除权的规制体系,建立行政合同诉讼制度,在受案范围、主体资格、事实认定、证据规则、判决形式等方面加以完善,促进行政合同中变更、解除权纠纷的合理解决。
