重构我国的夫妻财产制

在财产形式日益多样化的今天,面对纷繁复杂的夫妻财产关系,婚姻法关于夫妻财产制的修改,成为人们关注的热点和难点问题.笔者认为我国的法定夫妻财产制应为婚后所得共同制.同时确立个人特有财产制,建立夫妻共同财产的管理制度,设立离婚时夫妻财产的转化和补偿制度,提高和完善我国的夫妻约定财产制.

Reconstructing China's husband-and-wife property system

With the increasing forms of property and complicated property relations between husbands and wives, the expecting amendment to present husband-and-wife property system has become a public focus and a difficult task. This paper proposes that current legal husband-and-wife property system should be changed into the property system of postnuptial income, the systems of personal peculiar property, shared property management and the property transform and compensation in divorce should be established, and the provisional property system should be perfected.
