| 摘 要： | 一些学者认为我国的犯罪构成体系存在着严重弊端,需要进行根本性的变革,从而提出了许多新的犯罪论体系,其中最主要的是德日递进式的犯罪论体系。我国与德日递进式的犯罪论体系都有自身的优点和缺陷,我国犯罪论体系改革的思路是在坚持我国目前通行犯罪论体系的基础上吸取其他犯罪成立理论中的合理因素以完善我国的犯罪论体系。

| Abstract: | Some scholars think our crime theory system need to be changed foundamentally because of its series shortcomings,so they raised a number of new crime theory systems including three-level crime theory system of German&Japan.Both our and Germany&Japanese crime theory system have their own merits and defects.In my opinion,we should insist our crime theory system,and at the same time the reasonable factors of other crime theory systems should be assimilated critically. |
