经济全球化与私法观论略

入世必将引发中国的深层次法制变革。仅仅表面上的法律创制活动不能符合经济全球化的要求 ,为此 ,必须确立以自由、平等为中心的私法观。本文提出平等、自由的私法观念是经济全球化的必然要求 ,分析了中国私法观现状中不适应经济全球化要求的表现 ,指出要培固适应经济全球化要求的私法观。

A Glance at Economic Globalization and View on Private Law

The entry into WTO will lead to the deep reform in Chinese legal system, but only the superficial legislation could not meet the requirement of economic globalization. So we have to set up the private law view centered on freedom and equality. In this article,authors argue that the private law view centered on freedom and equality is the necessary requirement of economic globalization, and analyze the aspects where current situation of Chinese private law view does not fit the requirement of economic globalization, and point out we should bring up and consolidate the view on the private law which will be adaptive to economic globalization.
