《工伤保险条例》实施效果及立法完善——基于定量分析的思考

统计分析煤矿、铁路行业等风险较大行业和中等风险行业在1995年至2010年间工伤事故数大幅下降,说明《工伤保险条例》实施效果显著。工伤保险立法应扩大保护覆盖范围,细化行业差别费率和行业内费率档次;应注意同类立法时间的恰当衔接,有效提升各法的实施效果;下一次修正《工伤保险条例》宜与本次修正间隔4-5年;加快配套法规立法,争取工伤保险法实施效果最大化。

Research on Enforcement Effects and Recommendable Measures to Improve Regulation on Work-Related Injury Insurances based on quantitative analysis

The substantial decline in the number of industrial accidents in 1995—2010 in coal mine industry as a typical example of industry with higher risk of accidents and in railway industry as a typical example of industry with moderate risk of accidents shows that Regulation on Work-Related Injury Insurances is quite effective.Injury insurance law should expand the coverage of protection,to refine the different insurance rates in different industry and different grades of insurance rate accepted by different enterprises in the same industry,etc.,to improve the protective level.It will be better if there is with the appropriate interval of 4—5 years from this amendment to the next one for the Regulation.It is possible to seek maximum enforcement effects of injury insurance law and regulations if supporting regulations and rules will be made.
