“以人为本”与“宪法至上”

以人为本就是以人为价值内核和价值本源 ,最终促进人的全面发展 ,核心在于尊重和保障人权。宪法至上意味着宪法在国家和社会生活中具有至高无上的地位和权威。从宪法的核心价值看 ,以人为本与宪法至上是契合的。法律文化传统中“宪法至上”思想和人文精神的缺失 ,公众法律意识的现状及对宪法至上理解上的偏差 ,对“以人为本”认识的混乱和滥用因素是二者产生隔膜的根源。其冲突通过明确人权的界限 ,限制政府权力来协调。

Constitution is the top and human being is the all

That human being is the all means man is the core and origin of value, thus human right should be respected and protected. That constitution is the top means constitution has the supreme position and authoritative power. They should harmonize each other. But prejudicial understanding of the two concepts causes isolation of them. We can coordinate the conflicts by clarifying the range of human right and limit the governmental right.
