检察官管理体制改革的理论与实践

检察权具有行政性和司法性之双重属性,从而决定了检察官管理必须符合检察权运行规律的要求。完善检察官管理制度,其基本取向应当是减少行政性,增强司法性。对检察人员实行分类管理,要突出检察官在检察人员中的主体地位,建立健全检察官职业准入、晋升考核、职业培训、逐级遴选和身份保障等相关制度,推进检察官职业化建设。

Theory and Practice of Reform of Prosecutor Administration System

The procuratorial power has the dual nature of executive and judicial power,which determined that the prosecutor ad- ministration should accord with the requirement of functional rule of procuratorial power.The principal orientation of completion prosecutor administration system is to diminish the executive nature and increase the judicial nature.The classified administra- tion of procuratorial personnel shall be implemented by emphasizing the principal status of prosecutors within the procuratorial personnel,establishing and completing relevant system including access to prosecutor's profession,promotion examination,pro- fessional training,grade-by-grade selection and status protection,and professionalizing the prosecutors.
