国民心理对中国法制现代化道路的影响及其现代价值

中国人的国民心理对我国法制现代化进程产生了深刻的影响,从而使中国法制运作模式具有了自己的特色:道德在法律的运作中发挥着重要的作用;调解、私了等非法律手段在纠纷解决机制中发挥着重要作用;政府机构和民间力量在纠纷解决机制中发挥着重要作用,形成了司法部门、政府机关、民间力量三足鼎立的多元纠纷解决机制。我们既要看到由我国的传统文化和国民心理所决定的非法律手段在解决纠纷中具有重要作用的客观必然性和合理性,又要看到树立法律的权威、使法律成为维护社会秩序的主导力量的必要性。只有当我们的法律真正成为普通民众可亲、可近的东西的时候,只有当广大人民群众在心理上真正认可了法律的地位和作用的时候,法律的权威性才会真正树立起来,法律才会逐渐取代各种非法律手段而成为维护社会秩序的主导力量。

The Influence of National Mentality Over China''''s Legal Modernization and its Contemporary Value

The national mentality of Chinese have exerted in-depth influence on the modernization process of China's legal system,and thus led to the following features: moral plays an important role in the operation of law;non-legal means such as settlement out of court and mediation has an significant part in dispute settlement mechanism;and government agencies and private forces are important in dispute settlement mechanism and thus form a multiple-sided dispute settlement mechanism composed of judiciary sector,government agency and private force.We should be aware of the objective necessity and reasonability of non-legal means decided by our traditional culture and national mentality playing an important role in dispute settlement,and at the same time establish the authority of law and make it a dominant force in safeguarding social order.Only when ordinary citizens have easy access to our law,and realize the status and role of law can our law have real authority and replace all other non-legal means and become a pillar force for safeguarding social order.
