| 摘 要： | 通过比较英美法系和大陆法系主要国家、地区法律规范的不同规定,并参阅英美法系国家一些的海事判例,从多个角度分析"买卖不破租赁"原则在二手船买卖中的应用问题,指出民法的大多数原则并不都是当然可以应用在海商法中,海商法也并不仅仅是民法的特别法而已.
