论刑法中“非法占有目的”理论的内容和机能

财产犯罪中的"非法占有目的"是故意内容之外不成文的主观构成要件要素。"非法占有目的"必要说之所以遭致批判,主要是因为在其内容的理解上存在问题。因为必要说一方面将"利用意思"作为其内容之一,一方面又在很大程度上淡化了"利用意思"的本来涵义。由于"利用意思"要素的存在,使得"非法占有目的"在取得罪与毁弃罪、盗窃罪与盗用行为的区分问题上出现了逻辑悖论。将"非法占有目的"的内容限定为永久性地占有他人财物的"排除意思"具有妥当性,辅以"建立占有"的存在与否,"非法占有目的"不仅可以在区分盗窃罪与盗用行为、取得罪和毁弃罪的问题上发挥作用,还能在权利行使问题的解决上有所作为。

To solve this problem, we should qualify the connotation of the concept ＂the purpose of illegal possession＂ to ＂the purpose that removing owner＇s possession permanently＂. Besides, this qualification can also play a positive role in dealing with the problem which exists in the execution of rights.
